Terms of Service

1. Acceptance of Terms

By accessing or using the Hatch platform ("Service"), operated by ESCAPE VELOCITY OPERATIONS, SARL (SIREN 908 987 241), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Hatch is a cloud hosting platform for web applications. The Service provides automated build, deployment, and hosting of applications from Git repositories, along with managed PostgreSQL databases, custom domain support, and related infrastructure services.

3. Account Registration

To use the Service, you must register an account using a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Service to:

• Host, distribute, or link to illegal content
• Perform cryptocurrency mining or similar resource-intensive operations
• Send spam, unsolicited messages, or conduct phishing activities
• Abuse platform resources or interfere with other users' services
• Attempt to gain unauthorized access to the Service or its infrastructure
• Violate applicable laws or regulations

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.

5. Service Tiers

The Service is offered under the following tiers:

• Free (€0/month) — Applications sleep when unused and wake on request. PostgreSQL included. Suitable for side projects and experiments.
• Always On (€9/month) — Applications run continuously 24/7 with custom domain support and priority support.
• Team (starting at €29/month) — Multi-user collaboration with advanced features, team management, and dedicated support.

Pricing and features are subject to change. We will notify existing users of material changes at least 30 days in advance.

6. Data & Privacy

All data is hosted within the European Union. The Service is designed to be GDPR-compliant by default. For detailed information on how we collect, use, and protect your data, please refer to our Privacy Policy.

A Data Processing Agreement (DPA) is available for Team plan users upon request.

7. Uptime & Service Level

For the Free tier, the Service is provided on a best-effort basis with no uptime guarantee. For paid tiers (Always On and Team), we target 99.9% uptime measured on a monthly basis, excluding scheduled maintenance windows announced at least 48 hours in advance.

8. Intellectual Property

You retain all rights to the code and content you deploy on the Service. Hatch does not claim ownership of your applications or data. The Hatch platform, including its software, branding, and documentation, remains the intellectual property of Escape Velocity Operations SARL.

9. Termination

Either party may terminate the agreement at any time. Upon termination, you will have 30 days to export your data and applications. After this period, your data may be permanently deleted. We reserve the right to terminate accounts immediately in cases of serious Terms violations.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Escape Velocity Operations SARL shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill. Our total aggregate liability for any claim arising out of or relating to the Service shall not exceed the amounts paid by you to us in the twelve (12) months preceding the claim.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of France. Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the Tribunal de Commerce de Créteil, France.
